Principles of personal data processing

1. Personal data and their processing
1.1. Categories of personal data
We collect different data depending on which of our services you use.
When you shop with us, we collect:
Name and contact information – First and last name, email address, billing address, phone number,
Your Targeting Details – Information about you or your project, targeting location, required targeting for profiles, hashtags, and gender.
Information generated based on the duration of the contract until termination – Your Instagram and account details on our website. Login names and passwords
When you subscribe and receive marketing messages from us, we collect:
Name and contact details – email address and first name.
Demographics – country, gender.

1.2. Purposes of personal data processing:
Provision of services and their improvement. In order to provide the services we offer and improve them to your satisfaction, we process your personal data. Specifically, these include:
Processing of orders for goods or services ordered either through our website, mobile application or customer line. The legal reason is the necessity for the fulfillment of the purchase contract and for selected data to fulfill legal obligations (eg accounting documents).
Service availability alert. If you request a security check, we will process your personal information with your consent.
Customer support. In order to ensure customer service and to resolve any problems in the performance of the purchase contract, we process your personal data based on the necessary fulfillment of these contracts.
Communication. We use the collected data to communicate with you and adjust it individually. For example, we may contact you by phone, email, in-app, or other form to remind you that you have items in your online cart, help you complete your order, notify you of or update your application, order or claim status to learn more, or to notify you that you need to take the necessary action to keep your account active. If you buy from us as a non-member, we process this data because of a legitimate interest in Hypelogy’s legitimate interest, as described above.
Improving services. We use data to continually improve our services and systems, including adding new features, while making informed decisions using aggregate analysis and business intelligence, all based on our legitimate business-driven interest in the need to improve our services for success in competition. To ensure that your rights and interests are adequately protected, we use personalized data in an anonymized form for improvement.
Protection, security and dispute resolution. We may also process data for a legitimate interest in ensuring the protection and security of our systems and our customers in detecting and preventing fraud, resolving disputes, and enforcing our agreements based on a legitimate interest.
Newsletter to e-mail (business announcement)
We send you a sales announcement regarding products similar to the ones you purchased.
You can always reject these business notifications through the opt-out link found in each email. You can also contact our customer service or privacy officer directly to unsubscribe.
If you opt out of receiving business notifications, we will no longer use your electronic contacts for this purpose. We will start using them again if you register them or explicitly request them.
The marketing offers you see may be selected based on additional information we have collected about you over time based on contact information, demographics, favorites, and usage data from our products and websites (cookies, IP address, data provided your browsers, clicks data, business notifications displayed, products visited). We do not perform fully automated processing that has legal effects for you.
If you shop with us as a non-member, we process this data because of a legitimate interest in legitimate conventional marketing.
If you are not our customer, we process with your consent.

Processing of cookies from websites operated by Hypelogy
If you have cookies enabled in your web browser, we process behavioral records from cookies placed on websites operated by Hypelogy for the purpose of improving the operation of the Hypelogy website and for the purpose of Internet advertising by Hypelogy. See the separate chapter of this document for more information.
1.3 Transfer of personal data to third parties
Your personal data will be passed on to third parties or otherwise communicated only if it is necessary in the performance of the purchase contract and based on a legitimate interest or if you have given your prior consent.

(c) the carrier to deliver the products or services ordered by you and to deal with claims, including withdrawal

If third parties use the data in their legitimate interest, the controller is not responsible for such processing. Such processing shall be governed by the data processing principles of the companies and persons concerned.
2. Customer account and purchase without registration
a) When entering into a contract, we establish a customer account that is secured by a password. As part of your customer account, you get direct access to your data, including editing it, so you can view your completed and unfinished order data and edit your newsletter. You can also manage your personal data and receive a newsletter through your customer account.
b) If you do not wish to open a customer account for the purchase, you can also buy in our e-shop without registration, ie. j. as a non-member.
3. Security of personal data and retention period
3.1. Security of personal data
a) Your personal data is transmitted to us in encrypted form. We use the SSL (secure socket layer) encoding system. We safeguard our website and other systems through technical and organizational measures against the loss and destruction of your data, against unauthorized persons accessing, altering or disseminating your data.
b) We require our processors to demonstrate compliance of their systems with GDPR.
c) Access to your customer account is possible only after entering your personal password. In this context, please note that it is essential that you do not disclose your access data to third parties and always close your web browser window after you have finished your customer account, especially if you are using a computer with other users. Hypelogy does not take responsibility for misuse of the passwords used, unless Hypelogy directly causes this.
3.2 Processing period
We process and store personal data
at the time necessary to ensure all rights and obligations under the sales contract, i. j. during the order and warranty period
1 year from the end of the warranty period to resolve potential disputes
at a time during which Hypelogy is obliged to maintain as a trustee under generally binding legal regulations. Accounting documents, eg. Invoices issued by Hypelogy are legally archived for 10 years after being issued.
Consent for the availability notice remains valid until the availability information is sent, but no later than within 1 year or until its withdrawal.
Marketing approval is valid for 4 years or until further notice

In other cases, the processing period results from the purpose of processing or is governed by data protection legislation.
4. Rights of data subjects
a) If we process your personal data, you can request free information about the processing of your personal data at any time.
c) You also have the right to contact your Data Protection Officer or the Office for Personal Data Protection at any time.
d) You may withdraw your consent to the processing of personal data at any time. If you withdraw your consent to the processing of your personal data, your personal data will be deleted or anonymized; however, this does not apply to personal data that Hypelogy needs in order to fulfil its legal obligations (e.g. the execution of an already placed order) or to protect its legitimate interests. Personal data will also be destroyed if personal data is not necessary for the intended purpose or if the storage of your data is inadmissible for other legal reasons.
